With the abundance of bad news regarding the economy in general and the car business in particular, most dealerships have been paying too little attention to their wage-hour compliance. This could be a costly mistake for a number of reasons:

  • First, by downsizing and changing pay plans, dealerships have unknowingly lost overtime exemptions for certain employees and could become liable for thousands in unpaid wages.
  • Second, the new Secretary of Labor has announced that she intends to vigorously enforce the minimum wage and overtime laws. She is in the process of hiring 250 new investigators to do just that.
  • Third, plaintiffs' attorneys have discovered that filing wage hour lawsuits can be very lucrative. The law provides that if their client "prevails", that is, is entitled to any back wages at all, the attorney is automatically entitled to payment of all of the fees. Unlike discrimination cases, wage-hour cases are not covered by most dealership insurance policies. So every cent will come out of the dealership's pocket!
