This presentation will cover the top issues confronting dealerships today, including the Employee Free Choice Act ("EFCA"), recent amendments to the Family and Medical Leave Act ("FMLA") and the Americans with Disabilities Act, and common wage and hour and pay plan issues. As to the EFCA, the presentation will address the history of the proposed legislation and the impact of the current proposal on dealerships. With respect to the FMLA, the presentation will discuss the expansion of the statute to cover military-related leave, and the ADA discussion will focus on extended leave as an accommodation for disabilities. Wage and hour issues to be addressed include time-keeping requirements and mistakes. And the pay plan discussion will address both wage and hour, as well as contractual, aspects of pay plans.
