What’s a harassment complainant’s recourse if the employer takes no action?
Steve’s Answer:
From the complainant’s perspective, then they go to the EEOC or a plaintiff’s lawyer. From the employer’s perspective, the risk is that the complainant goes to the EEOC and that the harasser will do it again. Also, if you fail to take action and someone else is then victimized, there is no question that a jury would view that much more harshly.
