Customer Focus: Wrongful Termination Edition
Like many workforce compliance topics, employee discipline and termination isn’t exactly pleasant to think about—but that doesn’t mean it’s not important. Discipline and termination encompasses a wide range of policies, procedures, and practices. It is, in many ways, the nuts and bolts of how an organizational upholds its ethical values and legal responsibilities.
Because a subject matter with such a broad scope demands more than a single article, we’ve spent the last few weeks exploring discipline and termination in detail here on the Compli blog. We’ve looked at mistakes to avoid during a termination meeting; best practices before, during, and after making the decision to firing someone; a state-by-state breakdown of retaliation charges; and much more.
One thing we haven’t discussed much is how employers are putting these insights into practice in the real world. With that in mind, I asked a few customers about the ways they use Compli’s workforce compliance automation platform to facilitate discipline and termination and avoid wrongful termination claims.
And our customers certainly had a lot to say. One common theme was the versatility of the Compli platform. Customers told me that the right approach to discipline and termination allows them to cultivate positive workplace cultures while keeping their organizations protected in the event of a wrongful termination claim. In other words, the same system that underpins day-to-day operations can provide you with defensible proof of a decision in court or arbitration.
Multiple customers also commented on how Compligo makes it easy to use every incident as an opportunity to improve compliance. When an employee is disciplined or terminated, managers can use our platform to quickly reissue their organizational handbooks (or specific policies that were violated) to their entire workforce, collect attestations, and train or retrain any employees as necessary. This is, again, highly useful as a tool for legal defense.
Overall, customers said Compligo helped them save money and avoid wrongful termination lawsuits. One customer said that since implementing the system a year ago, they’ve won every wrongful termination suit filed against them and saved thousands of dollars.
Choice Quotes from Our Customers
“By using Compli, we were able to eliminate the termination claim and avoid fines. It’s been a lifesaver.”
“Compli has helped us with a number of unemployment claims. Through our documentation housed within Compli’s platform, we’ve been able to show that we’ve followed a progressive disciplinary process and that, despite our outreach, employees failed to rectify their behavior.”
An employer won’t avoid legal issues simply having Compligo in place. The key is to educate managers and track their compliance scores and status. And that brings me to our next big topic focus: manager support and development. Look out for a slew of articles, infographics, and webinars about that soon.
